If you use our services, we need to collect some personal information about you.  For technical reasons, this is necessary in order to make our web site safe and fit for purpose.  (Legal authority is provided by the General Data Protection Regulation (GDPR), Article 6(1)(1)e).

 

Your data is processed in accordance with current privacy regulations.  This privacy statement is designed to tell you how we process your data when you use our services.
 
The personal information you enter will be used only within the scope of the requested service.  It will not be forwarded to third parties outside the State Government, with the exception of service providers, government agencies or other institutions tasked to assist in providing the service.  The information will be disposed of as soon as it is no longer needed for delivery of the service requested by you.
 
This privacy statement applies irrespective of which domain, platform or other system we use and on which device the application runs.
 
Individuals under the age of 16 should not give us their personal data without the consent of parents or carers (holders of parental responsibility within the meaning of the GDPR, Article 8(1)).  The consent must then be included in the communication used to transmit the personal information (Article 8(2) of the GDPR).  We do not ask for – and nor do we knowingly collect - personal information of children or teenagers.

Legal authority

°   Where we obtain consent to the processing of someone’s personal data, legal authority comes from Article 6(1)(a) of the GDPR
°      Where processing is necessary for the performance of a contract to which the data subject is party or in order to take steps at the request of the data subject prior to entering into a contract, authority comes from Article 6(1)(b)
°      Where processing is necessary for compliance with a legal obligation to which the controller is subject, authority comes from Article 6(1)(c)
°      Where processing is necessary in order to protect the vital interests of the data subject or of another natural person, authority comes from Article 6(1)(d)
°      Where processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller, legal authority is provided by Article 6(1)(e) of the GDPR, read with Section 3 of the Data Protection Act (North Rhine-Westphalia).

Your statutory rights

These are your rights with regard to the personal information we collect and store about you:
 
°      the right to be informed in line with Article 15 of the GDPR
°      the right to rectification in line with Article 16 of the GDPR
°      the right to erasure in line with Article 17 of the GDPR
°      the right to restrict processing in line with Article 18 of the GDPR
°      the right to object within the meaning of Article 21 of the GDPR
°      the right to data portability within the meaning of Article 20 of the GDPR
 
Feel free to send an e-mail to internetredaktion(at)stk.nrw.de or write to the content management office at the address given in the Impressum legal disclosure notice.  The right to be informed and the right to erasure may be limited by the provisions of ss 10 and 12 of the Data Protection Act (NRW).
You are free to withdraw your consent to the processing of your personal data at any time.  This includes any consent given before the General Data Protection Regulation became effective on 25 May 2018.  Please note that withdrawal of consent will not affect the lawfulness of the processing before withdrawal.

Right to lodge complaint with supervisory authority

You are entitled to make a complaint to the North Rhine-Westphalia Commissioner for Data Protection and Freedom of Information about the way we process your personal information (Article 77 of GDPR read with Section 29 of the Data Protection Act (NRW)).

Processing

The Premier’s Department website is hosted by the ‘IT.NRW’ government ahencies, the ‘processor’ withing the meaning of the GDPR.

Unless otherwise specified, the following data is stored with IT.NRW

Log data

Every time you access this site, temporary information is stored as so called log files which might allow users to be identified.
Information that is recorded when you access the site includes
 
°      Date and time the request was received
°      Name of the requested Internet service, web resource and user action
°      Client request
°      Volume of data transmitted
°      Success notification
°      IP address of the computer making the request
°      Client information such as browser or operating system
 
Log data is needed for visitor statistics and to analyse and defend against cyber attacks (see also ‘Tracking and Statistics’).  The information is stored for up tp 48 hours and can only be accessed by the web administrators, before being backed up to tape and irrevocably erased after six weeks.

Tracking and statistics

This site does not use tools to track visitor behaviour.  For visitor statistics, the free analysing software, AWStats (http://www.awstats.org/) is used to analyse log data and store it in an anonymous format.  The information is not merged with data from other sources.

Cookies

The website uses so-called ‘cookies’. Cookies are small text files that are stored on your computer and saved by your browser. These serve to make our offer more user-friendly and effective for you. You can prevent the use of cookies by setting your internet browser so that it does not accept cookies. However, you can also determine in your browser whether you wish to be informed about the setting of cookies and allow cookies only in individual cases, whether you want to exclude the acceptance of cookies for certain cases or generally. You can also activate the automatic deletion of cookies when closing the browser or delete cookies manually at any time. How to do this depends on your browser. The first time you visit the website or a page, you will automatically be informed about the use of cookies.

Citizen advice and e-mail

You have various options for getting in touch with the Premier’s Department, including a contact form and a number of e-mail addresses.
 
The use of one of these options means that you are supplying your personal information voluntarily on the basis of Article 6(1)(a) of the GDPR.
 
The information volunteered to us need to be stored so that we can do what you wish us to do. The information might include:

If you use the contact form or the nrwdirekt@nrw.de address, yout personal information will be forwarded to the State Government’s ‘NRW Direct’ service centre before being passed on to the agency best suited to deal with your request.  The service centre is operated by (‘processor’ within the meaning of the GDPR):

Alternatively, you can always write a letter.  We will then store the information you volunteer to us, in order to be able to process your request.  The data might include:

The information generated and stored in this way will be deleted as soon as it is no longer needed to deal with your request.
 
Helpline of the ’North Rhine-Westphalia Direct’ service centre
As the State Government’s central point of contact, the service centre of the Premier’s Departtment operates a variety of helplines and other resources to assist in many specialised fields.  Whenever you phone us to get help, some personal and technical data is automatically stored:

  • Timestamp
  • Task type
  • Caller/sender (telephone number)
  • Selected address
  • Initial subject (selected helpline)
  • Connection status
  • Number of data records (per telephone and call)
  • Number of customer contacts
  • Duration of charged call
  • Customer call duration
  • Customer interaction
  • Customer holding time
  • Customer wait time
  • Number of callbacks
  • Number of callback connections
  • Callback talk time
  • Total wrap time
  • Direct selection of subjects
  • External contact
  • Inbounds
  • Outbounds
  • Dialler contact
  • Voice message recorded
  • Network overflows

Information may also be collected in cases where an issue cannot immediately be addressed or forwarded to another point of contact.
Data may include

  • e-mailed callback requests
  • contact form details
  • voice messages to ‘brochure service’ order centre

Data will be collected and stored only where necessary for completion of a request and may include names, e-mail or postal addresses as well as telephone numbers.

Online Brochure Service

You can use this service to order information material.  To deal with your order, we need some personal information which will be kept by the government’s IT.NRW agency and automatically forwarded to our sevice providers.  Since an online order constitutes a legal transaction and may entail contractual obligations, we will collect information such as
